Judge denies motion

The judge says Baez is asking everyone to "trust us." The lawyer is suggesting the public's only source of info would come from him and Casey's family. The judge says based on what he has seen so far --- he described the tapings released from the jail as "sterile."

He says he's going to side on the First Amendment and not grant Baez's motion. The calls and records remain open.

Casey leaves the courtroom.

Baez responds


Prosecutors elect not to speak. Baez says there is nothing in his motion that keeps the OSCO from investigating the case. They are releasing the info to the public -- but it would impede Casey's right to a fair trial.

Baez fears someone who has the child could learn Casey is talking about the case. This may spark the person - who could be nearby - to move. "Once she starts talking, all bets are off," he says.

At this point, Casey is only talking with the family.
