Couey denied a new trial
Topics: GeneralInverness, Florida - Convicted child killer John Couey will not be getting a new trial.
Friday morning a judge denied the defense's request. Couey was back in Citrus County court for the hearing. Defense attorneys argued the jury selection process during his Miami murder trial was not fair.
The jury recommended Couey get the death penalty for murdering 9-year-old Jessica Lunsford.

“There were jurors who said they heard parts of what the defendant’s confession were and that confession later of course was suppressed and also said they would hold the defense to a higher burden of proof that is something beyond a reasonable doubt. ”
The judge ruled there was no evidence to back up the defense's claims.
A mental retardation hearing will be held before Couey's final sentence is handed down by the judge. If it's determined Couey is mentally retarded he would be ineligible for the death penalty.
