mentally ill?

Inverness, Florida - John Couey was back in court this morning as his attorneys, once again, asked to have the trial delayed. Bu the motion was denied, and the trial will start in Miami on Monday.

Two other issues that came up in this morning's hearing; there will be a suppression hearing on Tuesday in reference to prison guard's testimony in the case.

Also, the defense is trying to say that Couey took a test that deems him mentally retarded. If he's found mentally retarded, he will no longer be eligible for the death penalty. The judge instructed the defense to enter a motion on that matter.
